Use of Personal Images: You grant StoryBook the right to use the images you upload or provide to the Service for the purpose of creating your storybook or comic book using AI assisted generation of text and images. StoryBook will use the images in accordance with its Privacy Policy. By uploading personal images, you grant us the right to use, display, and store your images on our website and its related services. We also reserve the right to use the images in promotional materials and advertising campaigns. Further, by uploading your images to the website, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, adapt, prepare derivative works from, distribute, perform, and display your User Content in connection with the Service.
User Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it. You understand that your User Content may be republished and if you do not have the right to submit User Content for such use, it may subject you to liability. You represent and warrant that you have the written consent, release, and/or permission of each and every identifiable individual person in your User Content to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your User Content in the manner permitted by these Terms of Service.
Use of the Platform & Content Policy: StoryBook AI operates as a Christian-based service. As such, certain themes including, but not limited to, witchcraft, spiritism, and themes that may contradict our faith such as homosexuality, beastiality, and particularly, any themes that may be harmful to children are excluded from the stories generated by our AI. Although our AI model is trained to avoid generating such themes, if, for any reason, such content is inadvertently generated, we reserve the right to withhold the creation of digital comics based on these stories. In such cases, users will be eligible for a refund of the token used for the story generation or, upon request, a refund of the monetary amount spent on the platform. We aim to maintain the integrity of our faith-based content and provide a positive experience to all our users. Your understanding and cooperation in upholding these values are greatly appreciated.

Content that promotes, encourages, or depicts acts of self-harm, such as suicide, cutting, and eating disorders
Fraudulent or deceptive activity, including:
ScamsCoordinated inauthentic behavior
Plagiarism
Academic dishonesty
Astroturfing, such as fake grassroots support or fake review generation
Disinformation
Spam
Pseudo-pharmaceuticals
Adult content, adult industries, including:
Content meant to arouse sexual excitement, such as the description of sexual activity, or that promotes sexual services (excluding sex education and wellness) Erotic stories
Pornographic stories or content
Political campaigning or lobbying, by:
Generating high volumes of campaign materials
Generating campaign materials personalized to or targeted at specific demographics
User Representations and Warranties: You represent and warrant that: (i) you either are the sole and exclusive owner of all User Content or you have all rights, licenses, consents, and releases that are necessary to grant the rights to User Content granted by you hereunder; and (ii) neither the User Content, nor your submission, uploading, publishing, or otherwise making available of such User Content, nor our use of the User Content as permitted herein will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights, or proprietary or other proprietary rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
Disclaimer for Third Party API: The Service uses a third-party API to create both AI generated stories through text and motion from a still portrait image(s) of the user. StoryBook does not control and is not responsible for the API or the results it produces. You acknowledge that the API is provided on an “as is” basis and that StoryBook makes no representation or warranty of any kind with respect to the API or its results.
Intellectual Property Rights: The Service and its content, features, and functionality are and will remain the exclusive property of StoryBook and its licensors. The Service is protected by copyright, trademark, and other laws. The stories generated by our AI model are provided to users for their personal use. Users have the right to use the stories they generate for their own purposes in various applications. StoryBook, however, reserves the right to use the content generated by users for promotional and marketing efforts related to the platform.
Changes to the Service and these Terms: StoryBook reserves the right to modify or discontinue the Service or these Terms at any time. If StoryBook makes material changes to these Terms, it will provide notice through the Service or by other means. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the updated Terms.
Termination: StoryBook may terminate or suspend all or a portion of the Service, your access to all or a portion of the Service at any time, without notice, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
Disclaimer of Warranties: The Service is provided on an “as is” basis. StoryBook makes no representation or warranty of any kind, express or implied, regarding the Service or its content, including without limitation any warranty of accuracy, completeness, reliability, merchantability, or fitness for a particular purpose.
Limitation of Liability: StoryBook will not be liable for any damages arising from your use of the Service or its content. This includes, but is not limited to, direct, indirect, incidental, special, consequential, and punitive damages, whether based on warranty, contract, tort, or any other legal theory, and whether or not StoryBook is advised of the possibility of such damages.
Indemnification: By using the Service, you agree to indemnify and hold StoryBook harmless from any claims, damages, losses, or liabilities arising from your use of the stories generated by the StoryBook AI, whether in print, copyright, or other media applications. StoryBook shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or relating to the use or inability to use the Service, including but not limited to any damages for loss of profits, goodwill, use, data, or other intangible losses resulting from (i) the use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through the Service by any third party; or (iv) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Service.
Governing Law: These Terms will be governed by and construed in accordance with the laws of the jurisdiction in which the Service is based, without giving effect to any principles of conflict of law.
Dispute Resolution: Any dispute arising from or related to these Terms or the Service will be resolved through binding arbitration in accordance with the commercial arbitration rules of the Jamaica International Arbitration Centre Ltd.
Entire Agreement: These Terms constitute the entire agreement between you and StoryBook regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral, relating to the Service.These terms and conditions (“Terms”) govern your use of the website and web app “StoryBook”, which allows you to create an AI aided generation of a storybook or comic book (“Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
